Terms of Service
Effective date: 28 October 2026 · Last updated: 28 October 2026
These Terms of Service ("Terms") govern your use of the websites and products provided by BLACK HOLE ("BlackHole", "we", "us"). They cover blackholes.cloud and its subdomains, and the products below.
1. Products covered
| Product | What it is |
| BlackHole Cyber | A cloud, multi-tenant security operations (SOC) platform at cyber.blackholes.cloud, with an agent you install on your own systems. |
| BLACK HOLE Digital Forensics | A licensed Windows forensic workstation for authorised operators, with vetting and licensing at license.blackholes.cloud. |
By registering for, installing or using any BlackHole product or website, you accept these Terms. If you accept on behalf of an organisation, you confirm you have authority to bind it.
2. Accounts and security
- Provide accurate registration details and keep your credentials confidential.
- You are responsible for all activity under your accounts. Enable multi-factor authentication where offered.
- Do not share accounts between people. Report suspected unauthorised access to security@blackholes.cloud.
3. Acceptable use (all products)
You agree not to, and not to permit any user to:
- Use any BlackHole product to monitor, access or examine systems, networks, data or devices you are not lawfully authorised to.
- Breach applicable law, including data-protection, employment, privacy or evidence-handling obligations.
- Attempt to breach the security of our services, access another customer's or tenant's data, or test our systems without our written consent.
- Upload unlawful content or data you have no right to submit, or introduce malware.
- Resell, sublicense or reverse engineer the products except as expressly permitted or as allowed by law.
4. BlackHole Cyber (SOC platform)
- The platform is multi-tenant; it is designed so one tenant cannot access another's data. You control which of your users have access and with what role.
- You must only deploy the agent on systems you own or are authorised to monitor, and you are responsible for notifying your staff and obtaining any consents the law requires before monitoring them.
- No security product detects or prevents every threat; you remain responsible for your own security decisions and incident response.
5. BLACK HOLE Digital Forensics
- The Forensics product is licensed only to vetted operators and bound to an authorised machine. Licences are non-transferable.
- Lawful use only. It is designed for consent-based or lawfully-authorised examination. It does not bypass lock screens, passcodes or encryption. You may use it only where the device owner is present and consents, or you hold a warrant or other lawful authority, and you must record that authority in the case.
- You are solely responsible for the lawfulness of each examination and for handling the resulting evidence in accordance with the law. Data you extract is processed on your own machine; see the Privacy Policy.
- We may suspend or revoke a licence where we reasonably believe it is being used unlawfully or in breach of these Terms.
6. Your data
As between you and us, you own your data. For BlackHole Cyber, where the data you send contains personal data you act as the data controller and we act as your processor, as described in the Privacy Policy; a separate Data Processing Agreement is available on request. For the Forensics product, extracted data stays on your machine and we do not receive it.
7. Availability and support
We aim to keep the services available but do not guarantee uninterrupted operation. Any specific availability or response commitment (an SLA) applies only if agreed with you in writing.
8. Fees
Fees, billing cycle and payment terms are as stated in your order, subscription or licence. Fees are exclusive of applicable taxes unless stated otherwise. Late payment may lead to suspension after reasonable notice.
9. Intellectual property
We and our licensors own all rights in the products, software and related materials. You receive a non-exclusive, non-transferable right to use them during your subscription or licence. You keep all rights in your own data.
10. Warranties and disclaimers
The products are provided "as is" and "as available". To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or loss of profits, revenue, data or goodwill. Our total aggregate liability relating to a product is limited to the fees you paid for that product in the twelve (12) months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.
12. Term and termination
- These Terms apply while you use any BlackHole product or website.
- Either party may terminate for material breach not cured within 30 days of written notice.
- We may suspend or limit a service immediately where necessary to protect the service, other customers, or to comply with law.
- On termination your right to use the product ends; for BlackHole Cyber you may request export of your data within 30 days, after which we may delete it.
13. Governing law
These Terms are governed by applicable law, and any dispute is subject to the competent courts, without prejudice to mandatory consumer rights.
14. Changes
We may update these Terms and will change the "Last updated" date; for material changes we will give reasonable notice. Continued use after changes take effect means you accept them.
